Changes to sentencing guidelines for health & safety offences

As of 1st February 2016 the sentencing guidelines for health and safety offences in the UK have changed.
Now more structured in their approach, the guidelines contain more detailed guidance for the magistrates responsible for determining appropriate fines.
Imposed to aid consistency and create a fair, level playing field for all, the guidelines state that all fines are now determined based on two factors: the severity of the breach and the turnover of the organisation. The severity is determined by culpability and harm levels, both assessed against a four point scale, and starting points for fines are banded in line with these, as well as turnover.
It is hoped that the new structure will leave less room for disputes over penalties awarded, and the reasoning behind them.
